Legally, Can I Keep the Second Laptop?

Ask a Question
Legally, Can I Keep the Second Laptop?
Miss J Scanlan asks

I recently bought a laptop online and the website failed to deliver on time, they sent the item the following day BUT the day after that they also delivered another one!

My friend told me that after a certain amount of time the company would be unable to reclaim the item and it would legally be mine.

Is this true or is it just cheeky, wishful thinking?

Since 2000, the regulations surrounding this type of occurrence have changed somewhat. Before 1st November 2000, the law stated that the company that sent out any unsolicited goods received before this date had to be notified. The sender was then responsible for collecting the items within 30 days. After six months the receivers would be able to claim the unsolicited goods as their own.

Essentially, because you have not ordered the goods, they could be viewed as unsolicited goods, which is where the changes to the above statement become relevant. The Department Business Enterprise and Regulatory Reform (BERR) states that under the Unsolicited Goods and Services Act 1971, (as amended) it is an offence to demand payment for goods known to be unsolicited”. This basically means that if you have received items without previously requesting them, you cannot be billed for the items. You did not choose to enter into a contract with the seller to receive or pay for this item. Because you had actually ordered goods from the company and they sent you extra items in error, you have a duty to return them as they're not strictly unsolicited

Hi, I made a purchase from Curry's and paid part of it with a gift voucher and part by credit card. When I tried paying with my card, instead of bringing me to the order complete page, it brought me back to the payment screen, so believing that it declined the card, I used my wife's card and it eventually went to order complete. The next day when I looked at my orders, I had two identical orders under different order numbers. I tried reaching out to them several times and eventually did after about 48 hours, the first representative I spoke with, didn't understand my problem and when I asked to talk to a supervisor they just hang up. The second one, after trying to offer me a full refund on one of the orders :), eventually understood the predicament and said they are getting it sorted. But today, I started receiving packages from the doubled order. Want can I do? I just want the refund for the debit card payment from one of the orders and for them to collect the products I received by mistake.

I ordered a high spec gaming laptop for around £1300. They sent two! I had missed the delivery of the first one and got an email the next day saying that a replacement was on it's way. I just assumed that it was got broken in transit. When the second one came i rang the store to tell them what had happened. The man said technically i could keep it because it was their mistake but he probably shouldn't tell me that or take it to my nearest store which is a bit of a trek away.
So because he said that am i entitled to sell it now? I don't want to sell it to then be asked to return it when i no longer have it. Where do i stand with it? It's been sat in it's box under my bed for about a month now and i've heard nothing.

Hi
I originally attempted to purchase a desk and pedestal in a certain colour, however the company emailed me asking me to contact them as the desk and pedestal I wanted was not in stock in the colour I wanted. I called the company and I agreed to order another desk and pedestal in another colour, I paid for these items over the phone and received them with no problems i was informed the original order was cancelled this was approx 3 months ago.
They then sent the original desk approx 6-8 weeks ago, I have tried to call them at least two to three times a week asking them to arrange collection of the desk that should not have been sent. These attempts at telephoning them have been useless as no-one answers the phone. I have also emailed them weekly asking for someone to contact me in regards to returning the desk, again no one has answered any of my emails. I then received an invoice for the unwanted desk, so called them hoping to arrange collection, they answered straight away ( guess they thought they were going to get some money )I informed them of the situation but I was informed I needed to speak to another dept, I was giving a number and tried to call them, again no answer. I have had this desk, still in its wrapping sat in my dining room for approx 6 weeks now. What can I do if I cannot speak to anyone either via phone or email. What are my rights in regards to this.

I ordered a sink but instead they sent me 4 dining room chairs. I emailed them and they sent a sink the next day. I asked what I should do with the chairs and they said to keep them for now and they would send a courier to pick them up.
3 months later they are still in the box and starting to get in the way. Can I keep them?? Thank yiu

More than six months ago I spent €2000 on a musical instrument from a UK company, which was delivered to Germany. It turned out to be faulty, so I got a replacement and was told to wait for a return shipping label for the first one, which I never received despite asking for it several times - just silence from the company. Now I have two bulky instruments sitting in my small apartment and I don't know what to do with the unwanted one.
According to UK law how long do I need to wait until I can get rid of it? (sell it, dump it, whatever)
A big thanks to anyone who can help! Best regards, Peter

We had a faulty watch, we repeatedly got in contact with the company. 6 months later they said they were sending a replacement. We had to send the original watch off, nearly 3 weeks later and lots of calls they sent a replacement. The replacement went missing with the courier. So again over a week later with more calls they sent another replacement. However, 100 arrived. What do we do as we didn't order it, it was just meant to be a replacement for a watch

I recently ordered a mattress and the company sent the wrong size. After many unsuccessful attempts to contact them to resolve the problem I eventually got through to them and they promised to send another and collect he wrong one the following week. The replacement did not arrive so I eventually cancelled the order and informed the company that I was ordering elsewhere and if it did arrive it would be refused delivery. I opened a dispute with Mastercard and they have refunded the cost.

Since then the mattress ordered from the second company arrived and was perfect.

The first company also tried to deliver but delivery was refused.
We still have the original (wrong size) mattress, last week we received an email from a courier saying they would collect it on Thrusday, they didn’t turn up. I emailed the courier on Friday and they answered there was a problem at their depot and it would be collected on Monday, once again they didn’t turn up.

How long do I have to keep storing the wrong mattress before I can dispose of it in some way?

I ordered some furniture from an online retailer - and one of the tables was damaged. The retailer arranged for a replacement to be sent (which has since arrived) but then suggested that I need to take the damaged table to the local post office to return to them (they were going to send me a returns label to print at home). I sent an email to explain this wasn't feasible as I don't have a car and the PO is not within walking distance (certainly not when carrying a table) - but I've not had a reply since (was sent on 4th October). What are my rights to keep/dispose of the damaged table myself?

I ordered a wardrobe online and received it and today a second turned up, but don’t have any room to store it. Am I within my rights to tell the company that they have a week to collect it or I am going to throw it in the bin?

Hi, I have recently upgraded my mobile phone with my provider, I originally ordered to my home address and called to change the address as nobody would be home to accept delivery so instead I insisted on this being delivered to my work address where it would be signed for, I got the phone no issues at all however the next day a parcel came to my home address which was signed for by a neighbour. I got the parcel and it was another phone exactly the same as my new upgrade, I have contacted my provider to ensure my account is set up correctly and I was only being billed for one phone to which they confirmed, no mention of the second phone, they haven't yet asked for it back or even mentioned it to me despite two phone calls since delivery, do I send this phone back? Can I keep it? Any help appreciated thanks!

Windymill 25/06/2018 at 10:58 am
I ordered a piece of garden furniture at a show and the company scribbled my name and address down and said they would be in touch regarding delivery.
A few weeks after on 1st May I received a random text saying we can deliver your chair on Thursday. No name or details of company etc were included so ignored it thinking it was sent to the wrong number or the delivery wouldn't go ahead as I haven't confirmed to deliver anything.
On the Thursday evening there was a knock at the door and the man we spoke to at the garden show had delivered the item to the front of the house.
I explained that I didn't confirm a delivery with him and he said he had text to say he can deliver and I explained that I never confirmed delivery and didn't have payment on me for the goods.
He said not to worry and just call the office to make payment.

We are now 6 weeks on and I cannot get hold of anyone at the company to make payment. I have left quite a few messages for them to contact me but nothing.

What should I do.?

I ordered a jug over the internet.

A month later I emailed to say "where is it".

Sorry out of stock. Will take off the website and will issue a refund. A week later no refund.

I phoned "oh sorry" we will issue a refund today and send compensation.

Refund arrived and a "Granny style" book, sold by them as compenstaion (no relevance whatsoever).

Meanwhile the jug is STILL advertised on their website. Is this legal?
OnlineShoppingRights Editor 08/05/2018 at 12:33 pm
No, ask the retailer if they want it returned. As long as you are not inconvenienced in attempting to return, they can ask for it back.

Hello, i recently ordered a footstool from a company, and when it arrived it was the wrong material. I phone up, complained and got a new one sent to me in the style i had asked for, however upon delivery they did not collect old stool or even mention it. Am I within my rights to keep both as I techinically did not order the original?

Thanms
OnlineShoppingRights Editor 01/05/2018 at 11:55 am
No, you should inform them that both items have arrived. The company should arrange to collect the surplus item, but you should not be inconvenienced by this (i.e you shouldn't have to take it to a depot or wait in for it to be collected).
tom 30/04/2018 at 5:44 pm
Hello. I have recently sent a faulty item to a company and they sent a replacement using a courirer. Due to a mistake in the delivery address the item bounced around various depots and after a week I made a major complaint about this. The company replied by email saying that they sent a new replacement "in order to avoid waiting any longer for courier to try and rearrange delivery of a potentially missing or problematic parcel delivery".

The thing is, I have then received both parcels within a week. As I have not paid for the item, being a replacement, and being still very angry for the wait, I do not feel correct that I should be the one alerting the company that I received both parcels . Also they have not mentioned that I should tell them if I receive also the first delivery, so I would like to understand if this can be a case where I am entitled to keep both items, as compensation for the stress, or if there is a limit of time for the company to claim one of the parcels back, given that they ever go and see from the tracking page if an item were delivered or not.
Thank you in advance for your answer.

Give the retailer a call and tell them you've been sent the goods in error. They should advise you how to return the items if they want them back. This should not be at your expense or cause you inconvience.

I ordered £1500 worth of bedroom furniture online but when it came to pay the total was £9.99 (postage only) and a discount of £1500 so I continued on and they’ve only taken the 9.99 but the items have started arriving today, will I be billed for them?
OnlineShoppingRights Editor 19/03/2018 at 2:11 pm
Ask the retailer what they would like you to do. If they want you to return it, they should pay the return postage as it's their error.

Am I legally required to send it back?

Hi I ordered pair of shoes online which i duly received. The following day i received a second pair. I contacted the company to advise of their error and asked them to send me a prepaid postage label however they request I pay upfront they will refund me afterwards. I don't really think this is acceptable or convenient. ..can you advise me please? Thank you
OnlineShoppingRights Editor 16/02/2018 at 3:19 pm
Email the company and tell them of their mistake. Give them 14 days in which to advise you on how to send the item back (at no cost to you) and inform them that if you do not hear from them by the deadline, you will keep the item. Make sure you keep a copy of the email and that it is sent to the email address (or postal address) on the retailer's website.

In November I received at item ordered which turned out faulty. I returned it and a replacement was sent to me. I ten received a second replacement. I have contacted the company with no response, where do I stand and why should I do??

No you should just send them all back. You are not entitled to keep items sent to you in error.

Hi, I recently placed an order for 3 items which I received along with 2 additional items I didn't order. One was a duplicate of one of the ordered items and one was something completely different. In the package with extra items was a dispatch note which was incorrect, it showed the duplicate item plus one or my ordered items. I sent the following email to the supplier:

I have received my order but have the following issues:
The size M ladies jacket arrived first and was a little too big - it also has a price tag saying g £19.50 on it, making me wonder if I was going to be over charged in the first place.
When the size L jacket arrived with the hoody it was exactly the same size as the medium jacket- leaving me wondering if the medium was faulty and if it had been correctly sized would it have been a better fit. The two are identical in every way except the size on the inside label is different. I find this disappointing and it makes me question the quality and reliability of your products and sizing.
I have also received an additional parcel which I am going to be honest enough to declare (many people would just keep it and not say anything) - it contains a second red hoody and an additional light blue zip up one in the same size.
I look forward to your response as to what action should be taken.

I have since returned all 3 ordered items but still have the 2 additional items. Should I try to contact the company again? Am I entitled to keep these items?
Many thanks in advance.

I purchased a case of wine (6 bottles) from an online company on the 22nd of December and they arrived late on the 11th of January and my order was completely wrong. I've tried for the past week to contact the company via email and leaving voicemails, I've tried to ring in the past few days and my call doesn't go through.

I've googled reviews of said site of which numerous complaints are being made as they are irngoing other customers who either haven't received ordered or who have recieved the wrong order like myself.

How do I get a refund if I can't get in touch with the company? I was also wondering Is this classed as unsolicited goods? The wine was bough specifically for a party and I'm now only left with this wine and I was wondering whether they can legally charge me and or ask for me to return said wine?

Thank you!

Contact the retailer to ask how to return the items as they have sent an incorrect number of items and you haven't paid for them!
james 05/12/2017 at 7:41 pm
I recently made a large purchase of £4000, my bank declined the payment.

a week passed and i got sent a tracking number for the items i'd attempted to purchase, I called up my bank to double check the payment wasn't pending and they said no, we declined the payment as it looked fraudulent and we wont be allowing this merchant to take money.

Today, my goods arrived but i still have not been charged nor heard from the company. But the goods that have arrived are also missing 1 item ( i ordered 3 laptops but only received 2)

Where do i stand on this and what can i do?
OnlineShoppingRights Editor 20/11/2017 at 12:34 pm
Can you not arrange to leave it somewhere to be picked up for collection? If you goods were sent twice due to retailer error, you be able to return them free of charge and without inconvenience to yourself. Contact Asda customer services and explain that it's not convenient to have it collected midweek and as it's not your error, you cannot take time off work etc.
Liz 19/11/2017 at 11:45 am
Hi,
I ordered two rugs from Asda, one was delivered but the other was apparently not on the delivery van. I rang Asda and they contacted the courier and advised it was lost so they dispatched another.
Later the same day the original rug got delivered to a neighbour. We then also received the second rug but again delivered to a neighbour (so I couldn’t reject it)
I’ve contacted Asda to arrange collection and they advise they can only collect midweek and only give a 8-6pm slot.
I am at work all week so have advised I would need weekend collection, which they’ve said they don’t do. I also don’t have an Asda within several miles.
Is it reasonable to expect them to arrange weekend collection? What are my rights?
Many thanks
OnlineShoppingRights Editor 03/11/2017 at 10:46 am
You should have contacted the company that sent it at the time. They clearly put the wrong address on, so may not have realised where it was sent (in order to get it back). It's not an unsolicited item because it wasn't addressed to you. In these cases you should always, either contact the sender, or simply put not "known at this address, return to sender" on and take it to a post office/put it in a letter box.
Gary 02/11/2017 at 7:26 am
I had, what I presume is a new phone, sent to an unknown person at my address about 4 months ago. There was also a separate letter that was delivered to my house. I still haven't opened it as i presumed the company who sent it would have got back to me to ask for it back, or even the lady who's name was on the package. Neither have. What do I do now?
OnlineShoppingRights Editor 19/05/2017 at 2:41 pm
Just give the retailer a call or email them. They should be able to provide you with an easy/convenient option for returning them (eg. via a local store with late opening, or collection from your workplace etc). If they can't do this - they may let you keep them!!
Jonathan 18/05/2017 at 7:41 pm
Hi,

I recently ordered some trainers from New Balance which came the following week. I have ran in them and very much intend to keep on using them!

However, I have since received a duplicate order that I have not paid for or requested in anyway. I am happy to get in touch with them for them to pick it up but since I work 6 days a week is there a timeframe I'm allowed to enforce? i.e. As a customer we have "30 days" to return goods - is there something similar from my end?

Thanks.

Yes you should return these unless Debenhams say you can keep them.

I ordered school uniform from the specific school supplyer in Mid august. It finally arrived after 5/6 weeks which was a month last beer than it should have been. I contacted them several times as the uniform did not arrive before the start of school. I got no reply at any point and the phones were not answered on any of the dozens of occasions we rang. The order was incomplete when it did arrive so I contacted them yet again. I then got the additional item separately. A week later the whole order was sent again. I have contacted them by email and phone and tried to return the items via the school (which the company does not accept we are told). Where do I stand on keeping or selling these items? I do not want to post them back at my own cost as the chances of getting my money back are slim.

I didn't order anything but then 1 week later I received an email saying my order had been shipped along with an inovice for £64. Hello

Quick question, we have recently bought a new TV which had a minor fault, we reported and was given a replacement. However due to issues regarding delivery we now have two TVs. We have contacted Tescos to arrange another pick up but hear nothing in reply. It's been 3 months can we now accept this TV as part of our home?

I upgraded my phone with vodafone in January. However after a few minutes I found out they were going to delivery the phone to my previous address despite all recent correspondence going to my current address. I immediately contacted them to change it but they wouldn't so I cancelled my order. The phone was delivered to a random house on my old street. After about a month I acquired the phone and asked Vodafone to collect it. They said they would arrange for it to be collected by sending a bag to be collected by a courier. This request was put in writing along with a complaint. After a few weeks I contacted vodafone who confirmed they were dealing with the complaint. Six months later I have had no response to the complaint nor has the phone been collected. After all this time am I entitled to keep this phone?

No it's probably just Amazon's systems have processed the sale/order as completed. We suggest you just keep the items and the money...Amazon won't mind on this one occasion.

Hi i ordered 3 items from amazon plus plaid extra for 1 day delivery. It didn't come and was lost in transit so i asked for refund and day before refund was expected i got items delivered so i called them that i wanna keep items and amazon to keep my money apart from the extra 1 dat delievry which i paid for. And then i got my full 3 items refunded. And called and emailed amazon to take money out my account but i always get email from them that the payment couldn't be processed dont know why. Since I've been buying which this card before. Is it my bank blocking amazon taking money from me or not.
OnlineShoppingRights Editor 21/04/2016 at 2:23 pm
Not sure on this one to be honest. This sounds like it could be unethical behaviour on the part of the retailer. Either they said there was no stock yet sent you the item anyway and perhaps are now trying to get the higher price for it OR there is a genuine mistake and they thought there was no stock because yours was the last one and it was help up in transit or something. Try rining and say it's been delivered and you'll pay over the phone - just play dumb and refuse to pay a higher price if they suggest it.

Hello, I think this might be the place for answers (the rest of the internet is so unclear about these things),

I ordered (and paid for) the second edition of an item from a website but received version one of it.

After contacting the company they sent out the correct version and said the first would be picked up for return.

They did deliver the correct version but nobody came to pick up the original item. I told the company and they arranged for another pickup for return on another day. Again, nobody came.

It's becoming increasingly inconvenient to wait around for someone to pick up the parcel and I've already spend two whole days aimlessly sitting around at home to no avail.

There's nothing in their terms and conditions about this kind of thing happening - Do I have to keep waiting around for failed pick-ups or can I just get on with my life?

I'm almost spending as much time looking for an answer as I am waiting for the item to be picked up, please help!

Matt :)

The company should refund/replace the hob under consumer rights legislation, but if you want to claim extra compensation, you will have to do so via the legal system.

Hello,
I purchased a gas hon online and had it fitted by a Gas hob online and had it fitted by a Gas Safe engineer. On completion he found the one burner was faulty. The company say they will only payoff return postage. This means I will need to re-engage this fitter to reinstall then to reinstall the unit on its return. My question is should I be about 100 pounds out of pocket through no fault on my behalf?
Would appreciate any advice.
Regards,
Ron

I placed an order in mid July and recieved a month later after some frustrating customer service. About a month later I recieved another package (the duplicate order) and decided to look up how to handle the situation. I found the arrival on the FTC's web site about unordered merchandise and it says in a nutshell that I can contact the seller about it and they arrange the shipping or I can keep it and don't have to do anything and the retailer isn't supposed to charge you for it. I decide to keep it on account of their poor customer service and think nothing of it. A couple weeks go by and I decide to check my bank statements to see if I was charged. I find that an unauthorized order was made 8/26 and charged $8 for something from that company( makes me want to keep it more), but its a smaller amount then what the duplicate was worth. Another couple weeks go buy and not thinking about anymore since I assumed I was in the right, I get an email from my bank saying my account is overdrawn, so I look. They charged me the full price of the tool. I emailed them asking them to reverse the charges and they told me they would only do it if they were to get the tool back when they send me a call card. To me, they kinda charged me on the down low. I told them according to the FTC article, I don't have to and sent them the link to it. Also told them im gunna go to my bank and report fraud and get them to reverse the charges(after I was advised I can do so). They tell me the FTC is fake and the bank will make me return the item once I get the call card and if I fail to do so, the bank will keep the charges. I just need to know if I'm right or a complete jack#&@ and to send it back.

@whobiggs. If you have been sent items by mistake you should (as you have done) contact the company and request that they come and collect the goods. You should not incur any cost or incovenience relating to this. We suggest you email the company and give them a deadline to collect the goods stating that after this time you will keep them, dispose of them, or give them to charity. Keep records of all your attempts to contact the trader and get the goods collected.

I recently received an order for a company by the name of Cycleworks, mine is Cyclewirks and immediately phoned the distributor up to report it. They said they would send a courier to collect but no one came. I have emailed twice to the sales people and now to five others just to make sure but no reply. The first email I sent on 23/03/15 approximately two weeks after the delivery came. I can't be bothered chasing them any more but how long do I have to have them sitting here before I can claim them as mine? I don't want to use/sell them and then get a bill.

Regards
David

I went onto a website and I added an item to my basket. I went to the checkout and entered billing and shipping information but I did not complete the order as I changed my mind about buying it.

I received a confirmation e-mail for the order even though I did not actually place it. No payment has been taken. If the package arrives, am I obliged to pay for it? The company has not contacted me regarding the order yet, aside from the automated order confirmation. If the package arrives, is it considered to be unsolicited goods and can I keep it, or am I legally obliged to pay for it or return it?

I phoned A*****n to them know they had sent 9 additional hard drives on top of the one that was sent to me. I did not order these can I assume that these items are unsolicited?

I did not receive a thank you for my honesty. Customer service were rude to me and upon putting the phone down said that they loved me.

I reported this and it was handled inappropriately breaching my confidentiality. I did not receive an apology that summed up why it was wrong the apology stated a technical error and that it was a misunderstanding.

IT WAS NOT A MISUNDERSTANDING - When I called A*****n I was on speaker phone and three other members of my family witnessed this call.
The last e-mail prior to pick up was sent to me this evening (less than 24 hours before pick up). The hard drives are being picked up tomorrow and only now have I been asked to print return labels when I don't have access to a printer nor will I have time tomorrow to get anything printed.

Update - day of collection:
The hard drives weren't collected. After everything that I have done for A*****n...am I legally obliged to let them know that there items weren't collected. I have informed them of there mistake already I now see it as there responsibility to contact me.

I have a question about this, something slightly different though. I made an order for 8 silver coins with an internet dealer but on arrival one coin was not silver but it was gold, which I did not request. I paid for the order in advance and paid the price for the silver. Is this unsolicited goods or goods sent in error? I advised the seller the same day but no response after 3 days. I know I do not have to return it, and that this is the sellers responsibility to make arrengements to collect or pay return postage, but if they do not, how long before the coin becomes mine?
